1. Acceptance of Terms

Welcome to Agent Craft. These Terms of Service ("Terms") govern your access to and use of the Agent Craft website, mobile application, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Agent Craft is an autonomous AI marketing platform designed to help teams build and manage their professional brand through voice-driven content creation. Our Service includes:

Voice-based content creation tools for recording professional insights and experiences
AI-powered content generation across multiple channels (LinkedIn, X/Twitter, Instagram, Facebook, blog, email, and more)
Voice transcription services using AI technology
Content personalization using Anthropic Claude AI
Analytics and performance tracking for your content
Professional brand development guidance
Competitor and industry monitoring

3. User Accounts

3.1 Account Registration

To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account
Ensuring you are at least 13 years of age (or the age of majority in your jurisdiction)

3.2 Email Verification

All users must verify their email address before accessing paid features. We use email for important service communications, security notifications, and account recovery.

3.3 Account Security

You agree to use a strong password and enable any additional security features we provide. We are not liable for any loss or damage arising from your failure to maintain account security.

4. Subscription Plans & Billing

4.1 Subscription Plan

Agent Craft is offered at $749/month with unlimited team members, 3 publishing destinations included, and additional destinations available at $100/month each.

4.2 Free Trial

New subscribers receive a 30-day free trial. No credit card is required to start your trial. If you do not subscribe before the trial ends, your access to paid features will be suspended.

4.3 Billing & Payment

Payment Processing: All payments are processed securely through Stripe. We do not store your full credit card information.
Recurring Billing: Subscriptions automatically renew on a monthly basis. You will be charged on the same day each month.
Price Changes:We may change subscription prices with 30 days' notice. Continued use after notice constitutes acceptance of new pricing.
Taxes: Prices do not include applicable taxes, which will be added to your invoice as required by law.

4.4 Cancellation & Refunds

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
No Refunds: Subscription fees are non-refundable, except as required by law or at our sole discretion.
Trial Cancellation: Cancel before the trial ends to avoid charges. No charges apply if you cancel during the free trial period.
Access After Cancellation: You retain access to paid features until the end of your current billing period.

5. AI Processing & Third-Party Services

5.1 Consent to AI Processing

By using our voice recording and content generation features, you explicitly consent to:

Sharing your voice recordings with OpenAI for transcription using Whisper AI
Sharing your transcripts and professional context with Anthropic for content generation using Claude AI
Processing of your data by these third-party AI providers as described in our Privacy Policy

5.2 AI-Generated Content Disclaimer

No Guarantee of Accuracy: AI-generated content may contain errors, inaccuracies, or inappropriate material. You are responsible for reviewing and editing all content before publishing.
Your Responsibility: You remain solely responsible for all content you publish on third-party platforms.
No Liability: We are not liable for any consequences arising from your use of AI-generated content.

5.3 Data Training Policy

Your data is not used to train OpenAI or Anthropic models. Both providers process your data solely to deliver our Service under strict data processing agreements.

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its design, features, code, graphics, and documentation, is owned by Agent Craft and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

6.2 Your Content

You retain all rights to the content you create, including:

Voice recordings you submit to the Service
Text you write or dictate
AI-generated content produced through our Service

By using the Service, you grant us a limited license to:

Process your content to provide the Service
Store your content on our servers
Share your content with third-party AI providers (OpenAI, Anthropic) as necessary to deliver the Service

This license terminates when you delete your content or close your account, except for backup copies retained according to our data retention policy.

7. Acceptable Use Policy

You agree not to use the Service to:

Violate any laws, regulations, or third-party rights
Post or generate harmful, offensive, defamatory, or illegal content
Impersonate others or provide false information
Distribute spam, malware, or viruses
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with the Service's operation or security
Use automated tools (bots, scrapers) without our written permission
Generate content that violates third-party platform terms of service
Resell or redistribute our Service without authorization

8. Third-Party Platforms

Our Service integrates with third-party platforms. Your use of these platforms is governed by their respective terms of service. We are not responsible for:

Changes to third-party platform APIs or features
Suspension or termination of your third-party accounts
Content policy violations on third-party platforms
Performance or availability of third-party platforms

9. Disclaimers & Limitations of Liability

9.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

9.2 Limitation of Liability

To the maximum extent permitted by law, Agent Craft shall not be liable for:

Indirect, incidental, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Errors or inaccuracies in AI-generated content
Actions you take based on AI-generated content
Third-party platform suspensions or policy violations

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9.3 Professional Advice Disclaimer

Agent Craft provides tools and guidance for content marketing, but we do not provide professional legal, financial, or career advice. Consult qualified professionals for specific advice related to your situation.

10. Indemnification

You agree to indemnify, defend, and hold harmless Agent Craft, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

Your use of the Service
Content you create or publish using our Service
Your violation of these Terms
Your violation of third-party rights

11. Termination

11.1 Termination by You

You may terminate your account at any time by using the account deletion feature in your settings or contacting support. Upon termination:

Your subscription will be canceled at the end of the current billing period
Your data will be deleted according to our retention policy (within 90 days)
You will no longer have access to the Service

11.2 Termination by Us

We may suspend or terminate your account immediately if:

You violate these Terms or our Acceptable Use Policy
Your payment fails or your account is delinquent
We suspect fraudulent, abusive, or illegal activity
Required by law or legal process
We discontinue the Service (with 30 days' notice)

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, you agree to contact us at support@agentcraft.ai to attempt to resolve the dispute informally. We commit to working in good faith to resolve disputes.

12.2 Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles.

12.3 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except where prohibited by law.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Agent Craft regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

13.5 Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes constitutes acceptance.
